GergerlioğLu’s Parliamentary Membership Will be Revoked

The Supreme Court upheld the 2-year and 6-month prison sentence for HDP Deputy Ömer Faruk Gergerlioğlu. After the final judgment is read in the TBMM General Assembly, Gergerlioğlu’s parliamentary membership will be revoked. Thus, the imprisonment process will begin for Gergerlioğlu, whose immunity will be lifted.

The 16th Criminal Chamber of the Supreme Court upheld the 2-year and 6-month prison sentence given to HDP Kocaeli Deputy Ömer Faruk Gergerlioğlu for the crime of ‘making terrorist organization propaganda’. This decision is an important step for the revocation of Gergerlioğlu’s parliamentary membership and the imprisonment process.

FIRST, PARLIAMENTARY MEMBERSHIP AND IMMUNITY WILL BE REMOVED

The Supreme Court’s final decision regarding human rights defender and Kocaeli deputy Ömer Faruk Gergerlioğlu will first be notified to the TBMM. With the reading of the final judgment decision in the TBMM General Assembly, Gergerlioğlu’s parliamentary membership will also be revoked.

According to the second paragraph of Article 84 of the Constitution, it contains the provision that ‘The loss of parliamentary membership due to a final conviction or restriction occurs upon the notification of the final court decision to the General Assembly.’
